Media once again unleash their malice against pro-life legislations

You may have read some strange headlines recently, such as the one TVA Nouvelles recently produced: "Even dead, a pregnant woman must stay plugged in because of Georgia's abortion laws". The headline refers to a pregnant woman who has been declared ‘brain dead’ and whose bodily functions are being maintained, if the headline is to be believed, so that the baby her body is carrying can be born, under an abortion law. I'll come back to this absurd idea of the "living corpse" a little later.

Why am I talking about this case? Because it shows several facets of the anti-culture of death in which we live.

The first is the malice of the media reporting on this case. If the woman in question, Adriana Smith, is really dead, how is it wrong to keep her body until a new life is born? It is true that the media approach the case mainly from the point of view of the grandmother, who expresses her discomfort at the fact that the decision regarding her daughter's body is not in the family's hands, but who nevertheless states, as reported elsewhere, that she wants the baby to be born. This incomprehensible media attitude can only be explained by the desire of the mainstream media to strike on pro-life laws on the slightest pretext.

But their impertinence doesn't stop there, because it turns out that it's not because of the "heartbeat" law that bans most abortions from 6 weeks in Georgia that Mrs Smith remains on life support, but because of the Advance Health Care Directives Act, passed in 2007 when Roe v. Wade was still in place, a law which prescribes that a pregnant woman in such a case must remain on life support unless the baby she is carrying is not yet considered "viable" and she has written an advance directive – which is not the case.

The problem with the concept of "brain death" is that it means that a person whose brain functions have ceased, but whose body is otherwise very much alive, is considered to be "dead". Which is absurd, because as we can see here, a woman can carry her unborn child – which is impossible with a corpse... As you no doubt know, organs are removed from people who are ‘brain dead’ if they have previously agreed to be "donors" – in some countries, people are automatically considered to be "donors" unless they have expressly indicated that they do not wish to be... The other problem is that the latest American Academy of Neurology guideline on "brain death" allows it to be declared, even if brain waves can still be detected in the person or the part of his brain called the hypothalamus is still functional – effectively violating the Uniform Determination of Death Act!

The irony is that the fact that Mrs Smith is being kept on life support because of her pregnancy may save her life – there are several cases of people declared "brain dead" who have woken up.

If only medias would admit that Mrs Smith is not dead, they would have one more (admittedly spurious) argument in their arsenal. Keeping a pregnant woman in a coma plugged in against her previously expressed wishes would be tantamount to restricting her "choice". This is not about to happen, however, because to do so they would have to reject the notion of "brain death", which holds that a person is no longer a person when they lose their rational functions, an idea that is a corollary of the one that holds that a person only begins to exist when they begin to have functional rational capacities. As you will have realised, to reject the one would be to abjure the other; to recognise the humanity of people in a state of "brain death" would be tantamount to admitting the humanity of unborn children in their earliest stages.

Both ends of life are threatened by the anti-culture of death. That's why I invite you to join us on Saturday May 31th, for those of you who live close enough, in front of the Quebec National Assembly for the 2nd Quebec City March for Life. Join us in defending the lives of the unborn and the vulnerable!

For Life,
Augustin Hamilton
